The treatise is at the heart of the current Schelling renaissance—indeed, Heidegger calls it "one of the most profound works of German, thus of Western, philosophy." It is also one of the most demanding and complex texts in German Idealism. By tracing the problem of ground through Schelling's treatise, this book provides a unified reading of the text, while unlocking (...) the meaning of its most challenging passages through clear, detailed analysis. This analysis shows how Schelling's implicit distinction between senses of ground is the key to his project of constructing a system that can satisfy reason while accommodating objects that seem to defy rational explanation—including evil, the origins of nature, and absolute freedom. The essays in this issue of The Journal of Medicine and Philosophy explore an innovative voucher program for encouraging kidney donation. Discussions cluster around a number of central moral and political/theoretical themes: What are the direct and indirect health care costs and benefits of such a voucher system in human organs? Do vouchers lead to more effective and efficient organ procurement and allocation or contribute to greater inequalities and inefficiencies in the transplantation system? Do vouchers contribute to the inappropriate commodification (...) of human body parts? Is there a significant moral difference between such a voucher system and a market in human organs for transplantation? This paper argues that while kidney vouchers constitute a step in the right direction, fuller utilization of market-based incentives, including, but not limited to, barter exchanges, would save more lives and further reduce human suffering. Debates over health care have focused for so long on economics that the proper goals for medicine seem to be taken for granted; yet problems in health care stem as much from a lack of agreement about the goals and priorities of medicine as from the way systems function. This book asks basic questions about the purposes and ends of medicine and shows that the answers have practical implications for future health care delivery, medical research, and the education of medical (...) students. The Hastings Center coordinated teams of physicians, nurses, public health experts, philosophers, theologians, politicians, health care administrators, social workers, and lawyers in fourteen countries to explore these issues. In this volume, they articulate four basic goals of medicine — prevention of disease, relief of suffering, care of the ill, and avoidance of premature death — and examine them in light of the cultural, political, and economic pressures under which medicine functions. In reporting these findings, the contributors touch on a wide range of diverse issues such as genetic technology, Chinese medicine, care of the elderly, and prevention and public health. The Goals of Medicine clearly demonstrates the importance of clarifying the purposes of medicine before attempting to change the economic and organizational systems. Brain transplants have long been no more than the subject of science fiction and engaging thought experiments. That is no longer true. Neuroscientists have announced their intention to transplant the head of a volunteer onto a donated body. Response has been decidedly mixed. How should we think about the moral permissibility of head transplants? Is it a life-saving/life-enhancing opportunity that appropriately expands the boundaries of medical practice? Or, is it a bioethical morass that ought not to be attempted? For the (...) purposes of this paper, I set aside questions regarding the surgical operation’s technological plausibility so as to focus on very basic questions regarding personal identity and the morality of head transplantation. The analysis begins with an exploration of the embodiment of persons. It considers whether persons can be conceptually distinguished from all parts of their body, even if they cannot be physically separated from some parts without loss of personhood. It argues that in most cases replacing body parts with reasonably similar parts will not destroy the conditions for sustaining personhood. However, as I explore, the phenomenology of personhood is such that some physical changes may prove to be too significant to maintain personal identity successfully over time. Given such complexity and the significance of the costs involved, the moral permissibility of head transplantation likely depends on recognizing that persons may give permission to collaborate in common activities, including projects with which others deeply disagree, provided that they only utilize the services and resources of free and consenting others. This paper defends an in principle understanding of the authority of persons over themselves and, in consequence, argues for significant limits on morally permissible state authority. It also defends an account of the limits of permissible state action that distinguishes between the ability of persons to convey authority to common projects and what may be judged virtuous, good, safe, or proper to do. In terms of organ transplantation policy, it concludes that it is morally acceptable, and should be legally permissible, (...) for individuals to sell one of their kidneys while living, pocketing the cash to use as that person sees fit to advance their own understanding of their own best interests. Morally objectionable policy proposals, I argue, are not those that encourage individuals to sell a redundant kidney while living or families to sell the organs of a recently deceased loved one, but those that seek coercively to confiscate the organs of the recently deceased. Recognizing the authority of persons over themselves, and their ability to convey moral authority to common projects, including the sale of human organs for transplantation, would shed light on the medical marketplace and clarify public policy, while increasing the efficiency and effectiveness of procuring human organs for transplantation. ABSTRACTLeo Strauss argues that the “theologico-political” problem arose from the competing claims of rationalist philosophy and theology. Although he urges others to take sides in this debate, most theorists see it as insoluble, since it is rooted in competing traditions and different, non-demonstrable, epistemic principles. Strauss, however, argues that there is a common ground capable of sustaining a contest between the two: their appeal to the pre-philosophic understanding of justice as moral virtue. The contest between the Bible and Socratic-Platonic philosophy (...) centers on which of the two better understands what justice is, what completes it, and in what respect it is good. Strauss enables us to see why Plato’s Socratic dialogues became indispensable models for classical and medieval philosophers who sought to meet the challenge of theology on the vital common ground of philosophy and theology. This article argues that the alleged transfer of the remains of Julian to the church of the Holy Apostles in Constantinople may well have taken place. The fact that contemporary sources do not mention the transfer is not extraordinary. Furthermore, no legal reasons for excluding his reburial in the Apostoleion complex existed in the fourth century when burials were still under the jurisdiction of Roman, not ecclesiastical, law.

Generalizedn-gons are certain geometric structures (incidence geometries) that generalize the concept of projective planes (the nontrivial generalized 3-gons are exactly the projective planes).In a simplified world, every generalizedn-gon of finite Morley rank would be an algebraic one, i.e., one of the three families described in [9] for example. To our horror, John Baldwin [2], using methods discovered by Hrushovski [7], constructed ℵ1-categorical projective planes which are not algebraic. The projective planes that Baldwin constructed fail to be algebraic in a dramatic (...) way.Indeed, every algebraic projective plane over an algebraically closed field is Desarguesian [12]. In particular, an algebraically closed field (isomorphic to the base field) can be interpreted in every one of them. However, in the projective planes that Baldwin constructed, one cannot even interpret an infinite group.In this article we show that the same phenomenon occurs for the generalizedn-gons ifn≥ 3 is an odd integer. For each suchnwe constructmany nonisomorphic generalizedn-gons of finite Morley rank that do not interpret an infinite group. As one may expect, our method is inspired by Hrushovski and Baldwin, and we follow Baldwin's line of approach. Quite often our proofs are a verification of the fact that the proofs of Baldwin [2] forn= 3 carry over to an arbitrary positive odd integern(which is sometimes far from being obvious). As in [2], we begin by defining a certain collection of finite graphsK* and a binary relation ≤ on these graphs. We show that (K*, ≤) satisfies the amalgamation property. (shrink)

While many have suggested that to withdraw medical interventions is ethically equivalent to withholding them, the moral complexity of actually withdrawing life supportive interventions from a patient cannot be ignored. Utilizing interplay between expository and narrative styles, and drawing upon our experiences with patients, families, nurses, and physicians when life supports have been withdrawn, we explore the changeable character of boundaries in end-of-life situations. We consider ways in which boundaries imply differences – for example, between cognition and performance – and (...) how the encounter with boundaries can generate altered meanings important for understanding decisions and actions in these contexts. We conclude that the reliance on mere roles to support the moral weight of withdrawing medical interventions is inadequate. Roles that lead us to such moments are exceeded by the responsibility encountered in such moments. And here, we suggest, is the momentous character of withdrawal: it presents the grave astonishment, the trembling awe, in the not-being-there of the other in death. (shrink)

Too much routine, however, comes with a risk that morally important practices will be reduced to mere bureaucratic formalities, while practitioners become desensitized to ethically significant distinctions between cases. Clinical ethics consultation and organizational ethics must be set within the broader social and cultural context of the healthcare environment. This practice requires looking beyond mere legal compliance and the routinely false assumption that there are (...) unambiguous ethical norms that easily govern clinical ethics and hospital policy formation. Several inquires about healthcare over the past several decades have shown that the evolution of healthcare practices exhibit their own microcosm of local and political influences. Likewise, other studies have shown clearly the ways in which both external and internal institutional factors establish the sectors within which healthcare is delivered. Although restrictions have always been present in some form, it seems obvious that whatever the precise form of healthcare delivery that results from current changes in its organization, there are going (...) to be broader restrictions not only on the choices that providers will be able to make about individual patients' care and needs, but also regarding the character of their clinical judgments. Indeed, there are already reports of instances where physicians' contracts with managed care organizations forbid them to disclose the existence of services not covered by a plan. (shrink)

Political metaphors do more than punch up messages; they can systematically bias observers’ attitudes toward the issue at hand. What, then, is an effective strategy for counteracting a metaphor’s influence? One could ignore or criticize the metaphor, emphasizing strong counterarguments directly pertaining to the target issue. Yet if observers rely on it to understand a complicated issue, they may be reluctant to abandon it. In this case, a “metaphor extension” strategy may be effective: Encourage observers to retain the metaphor but (...) reinterpret its meaning by considering other, less obvious implications. The current studies support this claim. Under conditions where participants gained a strong epistemic benefit from a rhetorical metaphor, they were more persuaded by a rebuttal that extended that metaphor. The studies use converging operational definitions of epistemic benefit and offer insight into how political attitudes are made and unmade. (shrink)

These four little books, largely neglected by scholars, investigate knowledge, ethics, metaphysics, the problem of evil, and the intriguing relationship of God and the soul. They also take up the ancient philosophical project of identifying the principles and practices that heal human desires in order (...) to attain happiness, renewing this philosophical endeavor with insights from Christian theology. Augustine's later books, such as the Confessions, would continue this project of healing desire, as would the writings of others including Boethius, Anselm, and Aquinas. -/- Mark Boone's The Conversion and Therapy of Desire investigates the roots of this project at Cassiciacum, where Augustine is developing a Christian theology of desire, informed by Neoplatonism but transformed by Christian teaching and practices. The last half-century has seen enormous changes in society’s attitude toward sexuality. In the 1950s, homosexuals in the United States were routinely arrested; today, homosexual activity between consenting adults is legal in every state, with same-sex marriage legal in Massachusetts and Connecticut. In the 1950s, ambitious women were often seen as psychopathological and were told by psychoanalysts that they had penis envy that needed treatment; today, a woman has campaigned for President of the United States. Mark Blechner has lived (...) and worked through these startling changes in society, and _Sex Changes _collects papers he has written over the last 45 years on sex, gender, and sexuality. Interspersed with these papers are reflections on the changes that have occurred during that time period, both within the scope of society at large as well as in his personal experiences inside and outside of the therapeutic setting. He shows how changes in society, changes in his life, and changes in his writing on sexuality - as well as changes within psychoanalysis itself - have affected one another. One hundred years ago, psychoanalysis was at the cutting edge of new ideas about sex and gender, but in the latter half of the 20 th Century, psychoanalysts were often seen as reactionary upholders of society’s prejudices. _Sex Changes _seeks to restore the place of psychoanalysis as the "once and future queer science," and aims for a radical shift in psychoanalytic thinking about sexuality, gender, normalcy, prejudice, and the relationship of therapeutic aims and values. This chapter explores the experiential reality of the family and its role in securing human well-being. I argue that the family is an epistemic category as well as an ontological category: it reveals the being of the phenomenological life-world in ways that are necessary for adequately appreciating the embodiment of human health and well-being. Without the family, there are significant areas of human flourishing about which one can neither know nor experience. The family uncovers categories of moral duties and virtues (...) central to the creation and maintenance of core areas of human well-being. Familial interactions, for example, routinely demonstrate significant forms of altruistic behavior and other-directed personal costs at levels that are atypical of nonfamilial relationships. Moreover, significant cross-cultural sociobiological data support the conclusion that family life provides social, emotional, adaptive, and financial advantages, as well as the development of affective autonomy, increased longevity, improved physical and psychological health. Conversely, traumatic changes to family life, such as the death of a spouse, are well-documented as negatively impacting personal stability, life-expectancy, and overall well-being. In short, to focus unduly on the individual in isolation from the family is to diminish this rich and significant category of human good and well-being. (shrink)

How can we definitively determine which biomedical choices are morally correct and which engage in seriously wrongful acts? Depending on whom one asks, one is informed that choices such as abortion, euthanasia, and significant body modification involve real moral harm (either as forms of murder or as denying the goodness of the body that God has provided), or that disallowing such “medical care” violates the basic rights of persons (where abortion, active euthanasia, and body modification are appreciated as positive expressions (...) of personal autonomy). Secular bioethics appears no longer able to appreciate what could possibly be wrong with such activities, provided that the individuals involved consent in some fashion. Indeed, many actions that were once openly and easily recognized as sinful have become so commonplace, as well as politically desirable, as to appear as if they were obviously good. As the authors in this issue of Christian Bioethics explore, fully to appreciate the serious moral issues raised by modern medicine requires a foundational orientation to the Christian God. (shrink)

Creation of for-profit markets in organs for transplantation ignites in many deep moral repugnance. Proposals to broker organs have been denounced by the US Congress and professional groups alike. Financial incentives are believed to undermine consent, coercing the poor into selling their organs, violating human dignity, and improperly commodifying the human body; such concerns are held to trump the possibility of increasing life-sustaining transplants. While such views summarize the apparent global consensus which marks worldwide prohibition of the sale of human (...) organs, I argue that closer examination reveals significant grounds for concluding that markets would be more successful in preventing exploitation, preserving human dignity, and protecting against improper commodification than governmental bureaucratic procedures for procuring and allocating organs. With rare exception, Roman Catholic moral theologians condemn the sale of human organs for transplantation. Yet, such criticism, while rhetorically powerful, often over-simplifies complex issues. Arguments for the prohibition of a market in human organs may, therefore, depend on a single premise, or a cluster of dubious and allied premises, which when examined cannot hold. In what follows, I will examine the ways in which such arguments are configured. For example, Thomas Aquinas’(1224-1274) understandings of embodiment and moral uses of the (...) body are usually interpreted as, and cited in support of, foreclosing a market in human organs. Aquinas’ principle of totality requires that one preserve the wholeness of the human body. In approaching Aquinas’ texts, I will assume the role of a revisionist who takes seriously his core commitments, while at the same time indicating that one can further develop his understanding of the body in ways which are supportive of the sale of human organs while remaining in conformity with the author's core concerns. Such considerations will provide significant grounds for concluding that a market in human organs for transplantation appreciates the embodied nature of the human person, respects the body and its parts as personal, rather than as mere things, is consistent with acknowledging God’s dominion over our lives and bodies, and constitutes an appropriate utilization of God's gifts to us. Moreover, such a market would likely create significant opportunities charitably to help others, to enhance human dignity and to protect against the serious dehumanization of current national bureaucratic procedures for organ donation. The Enarrationes in Psalmos are an important source for understanding the Augustinian theology of desire, linking it to his systematic theology and his pastoral practice. In this paper I illustrate by overviewing the expositions on Psalms 11 (12), 12 (13), 23 (24), and 26 (27). These Psalms teach us to love, trust, and seek God only, a failure to do which marks the Donatist schism. Augustine mingles ideas from pagan philosophy’s quest for eudaimonia or beata vita—the good, happy, and blessed (...) life—with biblical ideas. We want a stable happiness, and we must pursue wisdom; we can find stability in the rock that is Christ, to follow whom is to pursue wisdom rightly. Our desires must be converted to God, the only complete and perfect good and the source of eternal happiness, whom we must single-mindedly pursue with prayer and faith. While we must desire the eschaton and look to no earthly satisfaction, earthly goods may be received as gifts from God. One thing we can learn from studying the Enarrationes is how closely connected are the ideas of right love, the right church, and the right end; all three go together in Augustine’s theology. The COVID-19 pandemic has introduced new ethical challenges in the care of patients with serious psychiatric illness who require inpatient treatment and who may have beeen exposed to COVID-19 or have mild to moderate COVID-19 but refuse testing and adherence to infection prevention protocols. Such situations increase the risk of infection to other patients and staff on psychiatric inpatient units. We discuss medical and ethical considerations for navigating this dilemma and offer a set of policy recommendations.

This book represents a unique contribution to the field of clinical ethics consultation. What might seem at first glance to be an anthology, that is, a collection of independent essays, is actually more akin to a conversation, a shared engagement, a mutual undertaking. At the center of this conversation is a steadfastness, abiding and serious in its orientation – exemplified in these voices and contributions collected from colleagues – to explore, identify, and examine the actual conduct of individuals who engage (...) in ethics consultation practice. Although there is some helpful resemblance to an anthology, for example in the variety of ways these essays describe and depict a complex array of different standpoints regarding the practical and conceptual commitments in this growing field, more important to the Zadeh Project is the deliberate focus on explicating and probing the ways these commitments influence how a particular individual acting as an “ethics consultant” might understand and interpret the roles and prevalent expectations represented by those differing standpoints. In that light, and perhaps more urgently, this book is motivated by a mutual recognition that part and parcel with the responsibility of doing clinical ethics is an ongoing and clear need to describe and consider what clinical ethics consultants actually encounter when actively working with physicians, nurses, social workers, and other healthcare providers as well as with patients, families, and others who care about patients. As a contribution to that necessity of being accountable, this Project and the resulting book represent much more than merely collecting together the thoughts and perspectives of a group of colleagues from within a common field: this book is an attempt to display, to model through written text, a set of practices and what is at stake in these practices.
